IMPORTANT NOTE:
The above form is not a binding contract to rent the Davisburg Community Center. Rather, it offers a chance to put in a Rental Request, upon which we will then evaluate and contact you to speak in more depth about. For a look at what our Rental Agreement consists of, see below.


Terms of Agreement

The Lessor agrees to rent the following Davisburg Community Hall Facilities to the Lessee based on the attached rate schedule, which forms part of this agreement, for the Function Date, and Times noted above.

The Lessee and Lessor explicitly agree to perform their respective Responsibilities documented below which are an integral part of this Agreement to the best of their ability.

Lessee Responsibilities

  1. Ensure that no smoking of any type is allowed to occur within the Davisburg Community Hall, cigarette, cigar etc.

  2. Use the Hall within the laws of Canada and only for the stated Function Purpose.

  3. Arrange and pay for any required municipal, provincial or federal permits required for the Lessee's Function such as but not limited to licenses required to serve alcoholic beverages.

  4. Abide by any rules or regulations municipal, provincial or federal that forms part and or are a condition of a permit acquired by the Lessee for the Function.

  5. Ensure that the maximum posted capacity of the upstairs and downstairs Halls are not exceeded at any time

  6. Return the Hall at the end of the Function in a state of cleanliness and repair as existed prior to the commencement of the Function; normal wear and tear excepted.

  7. Complete all Function set up, take down and post Function Hall cleaning activities within the Date & Times noted in this Agreement

  8. Complete all of the activities on the Event Completion Hall Shut Down Check List, update checklist and return to Lessor along with any Hall keys signed out by Lessee.

Lessor Responsibilities

  1. The Lessor commits to provide the Facilities agreed to within this Agreement for the Lessee or invitees of the Lessee's sole use in a state of repair and cleanliness that one would expect in a similar rental facility in the MD of Foothills.

  2. The Lessor will provide heat, light, water/sewage, and cooking facilities (if Kitchen is part of the Facilities included in this Agreement).

  3. The Lessor acknowledges that it is the sole owner of the Hall and that all required municipal, provincial or federal taxes, insurance, licenses or assessments required to operate the Hall are in good standing with the respective bodies.

  4. Lessor will provide banquet style tables and stacking chairs in sufficient quantity to accommodate 120 people.

Cancellation Of This Agreement by the Lessee

  1. The Lessee may cancel this Agreement under the following conditions:

    • Cancellation request from Lessee 31 or more calendar days in advance of the Function Date: full reimbursement of the Rental Deposit.

    • Cancellation request from Lessee less than 31 calendar days in advance of the Function Date: no reimbursement of the Rental Deposit.

Payments Required As Part Of This Agreement

  1. Rental Deposit:
    A Rental Deposit must be provided to the Lessor by the Lessee within 5 business days of the Booking Date on this Agreement or this Agreement will become null and void. The Rental Deposit is defined as the greater of $100 or 50% of the Total Facility Rental Cost as documented and initialed above. This Rental Deposit will be applied to the Total Facility Rental Cost owed by the Lessee as part of this Agreement.

  2. Full Payment of Rental Costs
    Full payment of the Total Facility Rental Cost due under this agreement is due and payable to the Lessor on provision of a Key to the Lessee for the main doors of the Davisburg Community Association Hall.

  3. Damage Deposit
    A Damage Deposit in an amount as indicated in the attached Rate Schedule must be provided to the Lessor by the Lessee on provision of a key to the Lessee for the main doors of the Davisburg Community Association Hall. The Lessor will hold this Damage Deposit in trust and will return it to the Lessee if the Facility is returned in a state of repair post Function equal to the pre Function state.

  4. Cleaning Deposit
    A Cleaning Deposit in an amount as indicated in the attached Rate Schedule must be provided to the Lessor by the Lessee on provision of a key to the Lessee for the main doors of the Davisburg Community Association Hall.

    The Lessor will hold this Cleaning Deposit in trust and will return it to the Lessee if the Facility is returned in a state of cleanliness post Function equal to the pre Function state; normal wear and tear excepted.

Notes:

* Member rate applies only to Members of the Davisburg Community Association in good standing for two consecutive years

* The Lessee is responsible for the total cost to repair any and all damage caused to the Hall Facilities rented and used by them or their invitees irrespective of whether said costs to effect repairs exceed the Damage Deposit.
